1. Rental Agreement

These Terms and Conditions constitute a legally binding agreement between Algarve Scooter & Moto Rental ("we", "us", "our") and the customer ("you", "your") who rents a vehicle from us. By making a reservation or renting a vehicle, you agree to be bound by these Terms and Conditions.

2. Eligibility Requirements

To rent a vehicle, you must:

• Be at least 18 years old (21 years for motorcycles over 300cc)
• Possess a valid driver's license appropriate for the vehicle category
• Have a valid credit card in your name for the security deposit
• Present a valid identification document (passport or ID card)

3. Reservations and Cancellations

3.1. Reservations can be made online, by phone, or in person at our locations.
3.2. A valid credit card is required to secure your reservation.
3.3. Cancellation Policy:
- Free cancellation up to 48 hours before the rental start time
- Cancellations within 48 hours of pickup: 1 day's rental fee
- No-shows or cancellations after the rental start time: full rental amount may be charged

4. Pickup and Return

4.1. You must present your original driver's license, identification, and the credit card used for the reservation at pickup.
4.2. Vehicles must be returned to the agreed location on the date and time specified in the rental agreement.
4.3. Late returns will incur additional charges at our current daily rate plus a late fee.
4.4. Early returns do not entitle you to a refund unless agreed in advance.

5. Security Deposit

5.1. A security deposit is required at the time of pickup.
5.2. The deposit amount varies depending on the vehicle type and rental duration.
5.3. The deposit will be pre-authorized on your credit card and released upon satisfactory return of the vehicle.
5.4. Deductions may be made for damages, missing items, traffic fines, or other charges as outlined in these terms.

6. Insurance and Liability

6.1. Basic third-party liability insurance is included in the rental price as required by Portuguese law.
6.2. Optional additional insurance coverage is available for purchase.
6.3. You are responsible for any damage to the vehicle not covered by insurance.
6.4. The insurance does not cover:
- Damage caused by negligence or violation of traffic laws
- Damage to tires, wheels, windows, mirrors, or undercarriage
- Theft of personal belongings
- Damage caused while under the influence of alcohol or drugs

7. Vehicle Use

7.1. The vehicle must only be used on public roads within mainland Portugal.
7.2. The vehicle must not be used:
- For any illegal purpose
- To transport goods or people for hire
- For racing or speed testing
- To tow or push any vehicle or trailer
- By any person not named in the rental agreement
- While under the influence of alcohol, drugs, or any substance that impairs driving ability
7.3. Helmets must be worn at all times while operating the vehicle.

8. Maintenance and Breakdowns

8.1. You are responsible for the vehicle's basic care during the rental period.
8.2. Report any mechanical issues immediately to our emergency contact number.
8.3. Do not attempt repairs without our authorization.
8.4. In case of breakdown, we will provide roadside assistance and, if necessary, a replacement vehicle subject to availability.

9. Accidents and Theft

9.1. In case of an accident, you must:
- Notify the police immediately
- Contact us as soon as possible
- Obtain the details of all parties involved and any witnesses
- Complete an accident report form
- Not admit liability or fault
9.2. In case of theft, you must report it to the police and to us immediately.

10. Data Protection

10.1. We collect and process your personal data in accordance with our Privacy Policy.
10.2. By entering into this agreement, you consent to the collection and processing of your personal data for the purposes of the rental.

11. Governing Law

These Terms and Conditions are governed by the laws of Portugal. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the Portuguese courts.

12. Modifications

We reserve the right to modify these Terms and Conditions at any time. The current version will always be available on our website.
